Completely agree. She went through a lengthy process to calculate the financial damage incurred, and arrived at US$9,687.

Wouldn't you be pissed off if you were US$9,687 down?

She took it to a Small Claims Court, lawyers are not allowed (for either party). Jalopnik had a guy come in and write a piece about the case for them, its pretty interesting: http://jalopnik.com/5881497/how-you-...-court-and-win. The whole thing probably only cost her a few hundred bucks.

1) The EPA's estimates are 40 and 45 (city/highway respectively), with an average of 42. This woman claims her max was 42MPG. That's the combined average. She has no reason to complain.

2) American courts are retarded.

The California court system sucks ass. Gaurenteed that **** wouldn't pass in damn near every other state here.

She bought a car that claimed 42mpg and she complained, fair..dumb broad..

But the "software update" dropped the mileage to 30mpg...

Getting 30mpg out of a hybrid is a bit well..unreasonable....To argue against that is pretty dumb...she deserved to have her car fixed /replaced with one that atleast does the 42 again.

Does she deserve national press etc all this and a bunch of idiotic backwater yokles from the Shire talking about "omg quite right she needs more sterlings for her troubles good sir"..Nope...

But she should get more than 30mpg.

Anywho, Ty, couldn't it be that the woman is flooring the car a lot of the time. Consuming gas like there's no tomorrow? I mean... driving habits can EASILY lose the 12 mpg difference over a period of time.

Besides, the numbers on fuel economy is based on a set of predetermined routes that an "average joe" would be in. But no one in the real world does exactly what the test says it does. IMO, these numbers are great for comparing between other cars on fuel economy but it should not be a benchmark in which your car IS GOING to get.

There is soooo many things that could effect mpgs in a six year old car.

- Maintenance
- How you drive
- Repairs
etc etc etc

@ Breakfan -

Heres how small claims court in US works -

- No lawyers.
- Max amount to be awarded is 10,000.

So she (being a retired lawyer) against a manager from the local Honda dealership, isn't exactly fair. So she got nearly the max available.

Honda is pursuing action in higher courts with their own lawyers.

I highly doubt that she is getting 30mpgs in a 2006 civic without driving like a total lunatic. There are people with highly modified 2006 civics on another forum im a part of that still get mid 30's without it even being the Hybrid model.

well IF honda advertized 50....EPA got a COMBINED 42..

and she herself got a COMBINED 30....

And she is suing over "fuel economy" i'm betting she isn't driving the car like she stole it 24/7 for one, as a lawsuit isn't something you go to the local grocery store to do..she is probably concerned with fuel economy to begin with....

And once again she got a "avg" of 30..Avg meaning combined..This means she's probably getting...25mph city..and maybe 35 highway (guestimation)

That's pretty terrible for a hybrid, and we can ask coop if it's "simple or not" to get 12-15mpg LESS than avg in his car

and yes the EPA is a "random set of parameters" which is why SOME cars get horrible EPA's compared to what they should and others get better than expected....AS of the past...5 years american car companies have been producing automatic gearboxes that cater to EPA tests....while the rest of the world doesn't, which is why the CR-Z gets a crappy EPA rating but 90% of owners who have brought forth their mileage are well into the 40's without effort...


is this lawsuit stupid? sure...

but is she entitled to something IF these claims are true? yes..

The validity of her claim isn't something we can really discuss here as we don't know her, her path to work or her driving habits...

In this instance the best we can do is give her the benefit of the doubt that she isn't pulling random fuel economy figures from her butt and faith that the judge presiding at the LEAST asked for some sort of confirmation about fuel economy (ie gas receipt intervals and dates)

IF those however are congruent with the claims then yes i feel she deserved some compensation for the crap cars fuel economy and the spent $$$ already..

IE.. Down-payment (which is lost)..Fuel put in(lost) aint other maintaining fee's accumulated...And $ for the hassle.

I have yet been able to find anything that claims the 2006 Honda civic hybrid was claimed to get 50mpgs.

Heck even the 2012 brand spankin new Honda Civic Hybrid with IMA and other gizmos is only an advertised 44.

Also, I read, in small claims court - Evidence is not mandatory or looked upon as quite as significant as in real court.

Simply: take her car. Give it to scientist. And let them drive the car for some, lets say 300 miles. And collect data about fuel consumption. Problem solved. You will have the answer who was right. Or least wrong.

In mother russia, do they actually have a building that just has random frazzle haired men with glasses and white coats just walkin about waiting to be called upon?

This is small claims court dude, not the Supreme Court.

If she is seriously getting 30 miles to the gallon, then something is wrong with her car, and it needs to be fixed.

cant agree more with elctrctelsa. +-10mpg over or less than the sticker says isnt a big deal. probably driving habits or simply the car is getting old. i got a 2005 volvo s80 t5. sticker says 19mpg combined, 16 city, 24 highway. my numbers? about 12 city, and 32 highway (i have averaged 42 on a 130 mile trip). and what is my average since 46k miles ago? 13.5mpg. do i complain? no. and yet those are all good numbers because i am, as a fuel saver, a lead foot when i want to.
