Shouldn't the 2 be a subscript? In any case, isn't CO2 an emission that must be checked and limited by law?

If you don't have a cold air intake system then the CO2 will be present in the intake, therefore it will become part of the combustion. Question is will you be able to pass emissions with the increased amount of CO2?
